Gifting of Real Estate Properties is quite easy in Indian Laws

The popular opinion of all the Non-Residential Indian’s (NRI’s) is that Indian Real Estate Laws restricted to acquire the descent  real estate properties by the way of gift are very difficult. But the fact is that it’s very easy to get an Indian commercialor residential property from a resident of India or NRI or persons of Indian origin (PIOs) by an NRI or PIO. But a foreign national or non-Indian origin outside India can’t acquire this commercial or residential property by the way of gift in India.

On the other hand the person living outside of India can’t acquire Agriculture land, Form house and plantation by the way of gift in India. 

What is a Gift?
Under section 122 of the Transfer of Property Act, 1822, a gift is defined as “the transfer of a certain existing immovable property made voluntarily and without consideration, by one person, called the “donor”, to another, called the “donee” and accepted by and on behalf of the donee.”

According to Indian Real Estate Laws, it’s easy to get a real estate property by the way of gift in India.
